Is online casino legal in New York?

No. New York does not license online casino games. The Gaming Commission lists online casinos — including sweepstakes-style — as unlawful; the Attorney General has enforced that line.

New York online status in three lines

  3. 3

Sports wagering, ADW, fantasy, lottery — not casino games

A .com domain or “sweepstakes” label does not replace a New York Gaming Commission licence for casino games.

Sequence

How to check a “legal in New York” claim

  1. Step 01

Open the Gaming Commission, not the site

Start at gaming.ny.gov. If the product is an online casino or sweepstakes-style casino, the Commission’s consumer page already calls that unlawful.

  2. Step 02

Match the product to a licensed lane

Sports, ADW, interactive fantasy, and lottery each have their own Commission pages. Casino-style slots and table games do not appear there as a licensed remote product.

  3. Step 03

Treat AG and statute text as enforcement, not a loophole

Cease-and-desist letters and the December 2025 ban close the “it is only a promotion” framing. They do not create a grey legal tier.

  4. Step 04

    Keep land floors separate

A commercial casino hotel licence covers the building. It is not permission to offer internet casino games to New Yorkers at home.

Words that keep the New York story honest

Know before you sit

Unlawful online casino
The Gaming Commission’s label for remote casino-style offers that are not on its licensed list — including sites that call themselves sweepstakes.
Something of value
New York Penal Law gambling definition used by the AG: redeemable virtual coins can qualify even when some coins were obtained free.
Licensed sports / IFS / ADW
Separate online products with Commission oversight. They are not a substitute for a commercial iGaming statute.
Not legal advice
Orientation from Commission and AG public pages. Personal risk and new bills need the statute text or counsel.

Catalog fields

Status labels you can verify

  1. NO

    No iGaming statute

New York has no licensed commercial online casino program on the Commission’s gaming menu.

Tip: Empty licence list = no product

  2. SWP

    Sweepstakes ban

AG enforcement plus the December 2025 statute against dual-currency online sweepstakes games with cash-equivalent prizes.

  3. SPT

    Sports lane only

Mobile sports wagering is licensed separately — still not online slots or blackjack.

  4. C&D

    Cease-and-desist

Public AG demand that an operator stop prohibited gambling activity in New York.

    Tip: Enforcement, not a licence

  5. CMP

    Commission complaint

gaming.ny.gov invites reports on possible unlawful gambling via its published contact path.

Each label points back to a state page — not an affiliate roundup.

Watch outs

Common New York online-legality mistakes

  1. 01Reading “sports is legal” as “casino is legal”

Licensed mobile sports wagering does not authorize online casino games. The Commission lists them in different buckets.

  2. 02Treating a sweepstakes label as a loophole

The AG and the December 2025 ban treat dual-currency redeemable products as unlawful gambling, not a permitted promotion.

  3. 03Assuming a land casino brand implies online rights

A commercial casino floor licence is not an internet gaming permit for New York residents at home.

  4. 04Trusting an offshore “legal in NY” banner

Only the Gaming Commission’s licensed lanes count. Foreign seals and ad copy do not create a New York licence.

01Is online casino legal in New York?

Is online casino legal in New York?

No. The New York State Gaming Commission’s consumer guidance states that online casinos — including ones that claim they are sweepstakes — are unlawful in New York State. Of-age New Yorkers who wager online are pointed only to separately licensed lanes such as sports wagering, advanced deposit wagering, interactive fantasy sports, and authorized lottery rails. This page is orientation, not legal advice.

Are sweepstakes casinos legal in New York?

No. The Attorney General’s March 2025 letters treat most sweepstakes casinos as violations of New York anti-gambling law because redeemable coins are something of value. In December 2025 the state enacted a formal ban on dual-currency online sweepstakes games that offer cash or cash-equivalent prizes, and in September 2026 the AG announced a multimillion-dollar settlement with a leading operator. CasinoList does not name or link those products.

What online gambling is legal in New York?

Per the Gaming Commission’s “Avoid Risky Bets” page: sports wagering with licensed operators, advanced deposit wagering on horse racing by licensed providers, online raffles by authorized charities, interactive fantasy sports by licensed providers, and lottery tickets through the Lottery’s subscription program or licensed online couriers. Online casino games are not on that list.

Does New York have commercial iGaming?

Not as of our October 12, 2026 check. The Commission’s Division of Gaming menu covers sports wagering, commercial casinos (land), video lottery, Indian gaming, and interactive fantasy sports — not a licensed remote online casino program for casino-style games played from home.

02Land casinos and enforcement

Can I play casino games on my phone inside a New York casino?

This guide answers remote online casino legality for New York residents, not every on-property product a commercial casino may offer under its floor rules. For brick-and-mortar licensing context, start from the national land legality guide and the Commission’s commercial casino pages. Do not treat a land visit as proof that internet casino sites are licensed statewide.

How do I report unlawful online gambling in New York?

The Gaming Commission publishes a complaint path for possible unlawful gambling (info@gaming.ny.gov with an unlawful-gaming subject). That is a regulator channel, not a CasinoList service. We do not list or recommend online casino operators.

Is this page legal advice?

No. It summarizes public New York Gaming Commission and Attorney General materials as of the review date. Statutes, bills, and enforcement priorities change. For a personal situation, read the statute, contact the Commission, or ask qualified counsel.
