Indian casino age: 18 or 21?
Neither number is a federal rule. IGRA does not set a player age. Class III age is in that tribe’s compact; Class II age is in the tribal ordinance.

Floor rules
Words that keep the age honest
Know before you sit
- Player age
- The minimum age to wager or to be on the gaming floor. IGRA’s ordinance list in §2710(b)(2) does not include that number.
- Class III compact
- The tribal–state agreement for slots, house-banked tables, and other Class III games. Patron age, if any, is a compact clause.
- Class II ordinance
- The tribal law for bingo and non-banked card games, approved by the NIGC Chair. Age, if stated, is in that ordinance — not in §2710(b)(2).
- Per-capita “minors”
- §2710(b)(3)(C) protects minors who are entitled to tribal gaming distributions. That sentence is about payments to members, not the casino door.
- Not legal advice
- Orientation from IGRA and two compacts. A different nation, a later amendment, or alcohol rules can change the floor you walk into.
Sequence
How to check the age before you treat 18 as legal
Step 01
Name the class of game
Slots and house-banked tables are Class III. Bingo-style games are Class II. The age clause does not have to match across classes.
Step 02
Open the compact or ordinance
Class III: the tribal–state compact on the Bureau of Indian Affairs compact page or the Federal Register notice. Class II: the tribal gaming ordinance, not a roundup site.
Step 03
Search age, minor, and 21
Read exceptions. Sisseton’s Class III bar has a military-ID exception. Graton still allows under-21 staff in non-gaming jobs.
Step 04
Do not copy a commercial state’s age
Nevada’s 21 is a state statute for Nevada licensees. It does not become the age on Indian lands in another state.
What the two compacts actually say
| Compact | Play under 21? | Exception we read |
|---|---|---|
| Graton Rancheria, CA §6.3 | No gaming; no loitering there | Non-gaming jobs may be under 21 |
| Sisseton-Wahpeton, ND | No Class III wager under 21 | Military ID; raffle tickets |
Both documents are on bia.gov. A third nation’s compact can differ. This table is not a list of places to play.

01Is there a federal Indian casino age?
Are Indian casinos 18 or 21?
There is no single answer in federal law. The Indian Gaming Regulatory Act does not set a player age. For Class III games the number is in that nation’s tribal–state compact. For Class II games it is in the tribal ordinance. Two compacts we read — Graton Rancheria in California and Sisseton-Wahpeton Oyate in North Dakota — both restrict play under 21, with local exceptions.
Does IGRA say patrons must be 21?
No. Section 2710(b)(2) lists what a tribal gaming ordinance must contain: proprietary interest, use of net revenue, audits, contracts, public health and safety, and background checks for key employees. A minimum player age is not on that list. The only “minors” clause nearby, §2710(b)(3)(C), protects children who are entitled to per-capita gaming payments.
Why do people say Indian casinos are 18?
Some nations’ own laws or older compacts may allow a lower age, and roundup sites repeat “18+” as if it were federal. IGRA does not create that default. Treat an 18 claim as true only when that nation’s compact or ordinance says so, and only for the class of game it names.
02Compacts we checked
What age does the Graton compact set?
Section 6.3 of the 2023 Federated Indians of Graton Rancheria compact with California says the tribe will not permit persons under 21 to participate in gaming or to loiter where gaming is conducted, for the life of the compact. Persons under 21 may still be employed in a non-gaming capacity. That is one California compact, not every California tribal casino.
What age does the Sisseton-Wahpeton compact set?
The North Dakota compact’s Class III age rule says no person under 21 may make a Class III wager, except military personnel with military identification. A raffle ticket is also carved out of the “ticket” bar. Read the compact before assuming the same rule for bingo or for another nation in North Dakota.
03What this page will not do
Does CasinoList list tribal casinos by age?
No. This catalog does not yet publish tribal floors, and this page does not rank nations or link to casino sites. Use the Bureau of Indian Affairs compact file or the tribal ordinance for the nation you mean. The page is orientation, not permission to enter.
Is Nevada’s age the same on tribal land?
No. Nevada’s commercial gambling age is a state rule for Nevada licensees. Indian lands in other states follow that nation’s compact or ordinance. Do not carry a Nevada 21, or a rumor of 18, across a state line without the document.
