How online poker works

In a live poker state you sit at a geofenced table run by a licensed operator. Shared multi-state pools make the table bigger — they do not make poker legal in the other forty-five states.

In short

Key takeaways

  • Real-money online poker is legal only in a few states, and only while you are inside one of them.
  • The site makes money from rake, about 5% of each cash-game pot with a cap, or from tournament fees.
  • You play other people, not the house.
  • Use only a site that appears on your state regulator’s licensed list.

01Mechanics

How does online poker work?

In Delaware, Michigan, New Jersey, Nevada, or Pennsylvania you open an account with a licensed operator, pass geolocation, and sit at a table that uses the same hand ranks as a land room. Rake or tournament fees are disclosed in the client. Unlicensed.com rooms are not this stack.

02Advice

Is this page legal advice?

No. It describes the licensed poker stack using the poker state table. For an account dispute, use that board’s path or ask counsel.

03More questions people ask

Which states have legal online poker?

As of our October 13, 2026 check, online poker is live in 5 jurisdictions: Delaware, Michigan, Nevada, New Jersey, Pennsylvania. Every other state either has no law, has a law that has not launched yet, or limits play to a physical venue. Check the state regulator before you deposit, because launches and repeals happen mid-year.

How old do you have to be for online poker?

It depends on the state, not on the app. Of the 5 states where online poker is live in our October 13, 2026 check, 5 set 21 as the minimum age and 0 allow 18 or 19 (none). The operator must verify age and identity before the first real-money wager, so a younger player is refused at sign-up, not at cash-out.

How does an online poker site make money?

It takes rake, a small share of each cash-game pot, usually around 5% with a cap, or an entry fee on tournaments. The site does not play against you. The pot odds calculator on this site shows how rake changes the math.

Can I play real-money poker in a state where it is not live?

No licensed site will let you. Play-money and sweepstakes apps exist, but several state regulators treat sweepstakes poker as unlicensed gambling.
